1. Agreement to Terms

By accessing or using chatgains.com (the "Website") or our services, you agree to these Terms of Service. If you do not agree, do not use our services.

3. Services Provided

We provide:

  • Chat Services: Done-for-you chat management for creators and agencies, handling fan messaging to support engagement on their behalf.
  • Free Trial: A two (2) day free trial of our chat services so you can evaluate them before deciding whether to continue on a paid basis.
  • Informational Website: Information about our business and services.

Our services are provided on a best-efforts basis. We do not guarantee any particular level of earnings, engagement, or results, and actual outcomes may vary.

4. Eligibility

You must be at least 18 years old to use our services. By using our services, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.

5. Free Trial

To Start a Trial, You Provide:

  • Your name
  • Your email address
  • Whether you are a creator or agency
  • Your main platform
  • Your preferred contact method and handle (Telegram, WhatsApp, or email) or phone number

The Trial: We provide our chat services free of charge for a period of two (2) days so that you can evaluate them. The trial period begins when we start providing the services to you.

No Guarantee of Results: The trial is provided on a best-efforts basis. We do not guarantee any particular level of earnings, engagement, or other results, and actual outcomes may vary.

No Obligation: The trial does not obligate you to continue with our paid services, and does not obligate us to provide the trial or to accept you as a client. We reserve the right to decline, limit, or end a trial at any time.

After the Trial: At the end of the trial, you may choose whether to continue on a paid basis. You will not be charged unless you expressly agree to continue and to the applicable fees. Continued provision of our services is subject to a separate agreement and pricing agreed between us, which will govern the paid engagement and prevail in the event of any conflict with these Terms.

6. Acceptable Use

You agree not to:

  • Provide false or misleading information
  • Submit excessive or duplicate contact requests
  • Impersonate any person or entity
  • Use our services for any unlawful purpose
  • Attempt to gain unauthorized access to our systems or data
  • Interfere with or disrupt the operation of our website or services
  • Use automated tools, bots, or scrapers to access our website
  • Reverse engineer or attempt to extract source code from our services
  • Violate any third-party intellectual property or other rights

We reserve the right to refuse service to anyone for any reason.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENTERTALKPRO LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US FOR THE SERVICES GIVING RISE TO THE CLAIM.

NOTHING IN THESE TERMS EXCLUDES LIABILITY FOR FRAUD, FRAUDULENT MISREPRESENTATION, DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR ANY LIABILITY THAT CANNOT BE EXCLUDED BY LAW.

You agree to indemnify and hold harmless EnterTalkPro Ltd and its directors from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Your violation of any third-party rights
  • Any false or misleading information you provide to us
